3. Visiting the website

Each visit to our website requires certain information to be collected for technical reasons; this is primarily technical information, but in some cases it is categorized by law as personal information. This includes IP address, device identification, browser features, operating system details, language settings, referring URLs, length of the visit and pages displayed.

We will not use this information to identify you. However, the information is needed in order to properly deliver the content of our website and to provide law enforcement authorities with the necessary information for enforcement proceedings in the event of a cyberattack.

Further statistical analyses of this data, where applicable, will only take place after all personal references have been removed.

Our authorization to process the above data is based in part on our legitimate interest in operating a web presence (Art. 6 Sec. 1 lt. f of the General Data Protection Regulation). With regard to the use of data in order to provide it to law enforcement authorities, this authorization is based on the fact that in the case of a cyberattack, we are obligated to provide information to law enforcement authorities (Art. 6 Sec. 1 lt. c of the General Data Protection Regulation).

The only other recipient of this data is our hosting service provider, which hosts the website on our behalf.

We plan to store the abovementioned personal data for a period of 7 days and then to erase it.

We do not intend to transmit it to third countries outside the European Economic Area.

4. Newsletter

Our website gives you the option of subscribing to our newsletter. The newsletter tells you about news, trends, offers and other information about us and our products.

Subscribing to the newsletter is optional, and is not necessary in order to use the rest of our website.

If and to the extent that you subscribe to our newsletter, we will first collect your email address. We will exclusively use this information in order to send you the newsletter. We use a “double opt-in process” for subscribing to our newsletter. In other words, once you subscribe, we will send an email to the email address you provided and ask you to confirm (by clicking on a link) that you wish to receive the newsletter. If you do not confirm your subscription within 24 hours, your information will be blocked and automatically erased after one month. In addition, we will save your IP address and the subscription and confirmation times in order to document your subscription, and for clarification in the event that your personal data is misused.

We are authorized to process the abovementioned data on the basis of your consent, which you provide in the course of subscribing to our newsletter by clicking on the corresponding text field (Art. 6 Sec. 1 lt. a of the General Data Protection Regulation). In addition, in processing this data we are pursuing our legitimate interest in regularly providing you with news about SAKS OFF 5TH and documenting your consent to receive this news (Art. 6 Sec. 1 lt. f of the General Data Protection Regulation).

We plan to store the abovementioned data for the duration of your subscription and to erase it when you unsubscribe from the newsletter.

The data will be shared with our hosting service provider, which hosts the website on our behalf, as well as with the service provider that sends out our newsletter. It will not be shared with any other third parties.

We do not intend to transmit it to third countries outside the European Economic Area.

5. Google Maps

The Google Maps plugin is integrated into this website. Google Maps is operated by Google Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA (here: “Google”).

Each time you access an individual page with the Google Maps plugin integrated into it, the web browser on your computer is automatically asked to transmit data to Google in order to provide the Google Maps plugin. In the context of this technical process, Google will obtain personal data such as your IP address, which among other things is used to determine the origin of visitors and clicks. Specifically, your IP address, device identification, browser features, operating system details, language settings, referring URLs and geolocation data will be transmitted to Google.

The purpose of the Google Maps component is our legitimate interest in offering you an interactive map graphic with a navigation function (Art. 6 Sec. 1 lt. f of the General Data Protection Regulation).

You can adjust your browser settings accordingly or install plugins to prevent page elements such as Google Maps from loading automatically. If you use such settings or plugins, the map from Google Maps will not be displayed at all or will only be displayed once you explicitly agree to this, depending on your chosen settings; only then will the abovementioned data be transmitted to Google.

We do not store any personal data in the context of Google Maps.

This personal data is not transmitted to any other recipients.

6. Adobe Analytics

Components of Adobe Analytics are integrated into this website. Adobe Analytics is a tool that facilitates more efficient online marketing as well as web analysis, and is part of the Adobe Marketing Cloud. The Adobe Marketing Cloud allows real-time analyses of visitor flows on web pages. These real-time analyses include project reports and permit an ad hoc analysis of website visitors. Customer interactions are shown in a way that gives the Controller a better overview of the online activities of this website’s users.

Adobe Analytics is operated by Adobe Systems Software Ireland Limited, 4-6 Riverwalk, Citywest Business Campus, Dublin 24, Republic of Ireland (here: “Adobe”).

Adobe Analytics places a cookie on your computer. We provide a detailed explanation of cookies in Point 7 below. By adjusting the corresponding server setting, we anonymize the data sets transmitted to Adobe before any geolocation takes place. Data sets are anonymized by replacing the last part of the IP address. Adobe will use the data and information obtained from our website to analyze the user behavior of the data subject on our behalf. Furthermore, Adobe will use this data to create reports on user behavior on our behalf and to provide additional services for our company relating to the use of our website. Adobe will not combine the data subject’s IP address with any other personal data.

The purpose of the Adobe Analytics component is our legitimate interest in analyzing the visitor flows on our website (Art. 6 Sec. 1 lt. f of the General Data Protection Regulation).

You can prevent an automatic connection from being established by adjusting your web browser’s settings accordingly at any time; you will still be able to use our site, although to a limited extent. Adjusting your web browser’s settings in this way would also prevent Adobe Analytics from placing a cookie on your computer. In addition, cookies already placed by Adobe Analytics can be deleted at any time using a web browser or other software programs.

Furthermore, you have the option of objecting to and preventing the collection of data generated by the Adobe cookie in relation to this website as well as the processing of such data by Adobe. To do so, the data subject must click on the opt-out button under the following link: http://www.adobe.com/de/privacy/opt-out.html, which will place an opt-out cookie. The opt-out cookie placed by way of this objection will be saved in the data subject’s IT system. We do not store any personal data in the context of Adobe Analytics.
